Current: Private Area Construction Policy
a. Pursuant to Article II Section 2.03. of the Declaration, all exterior changes to a Member's structure, including painting and roofing must be approved by the MHA Board PRIOR TO the Member or Member's contractor (s) beginning work. Procedure for approval:
- The owner must complete and submit a completed Design Approval Checklist to the MHA Board along with appropriate plans and specifications for the proposed work, including a plot plan; drawings with elevations; description of exterior materials and colors, samples, trees to he removed or altered; and a proposed construction schedule.
- The MHA Board will require, on new construction, that the submission of plans and specifications be accompanied by an inspection fee of $450.00.
- If the MHA Board determines that the proposed work does not satisfy the requirements of the MHA CCR's and/or Policies, the MHA Board shall notify the Member in writing specifying the reasons for disapproval. The Member, may restart the process once the non-compliant issues have been resolved.
- If the MHA Board determines that the proposed work complies with the MHA CCR's and/ or MHA Policies, the MHA Board shall notify the Member in writing of the approval.
- All approved new construction must be completed within one (1) year after approval, or plans will have to be submitted to the MHA Board along with a new inspection fee.
- Upon completion of work for which approved plans are required under this section, the Member shall give notice to the MHA Board. Within ten (10) days the MHA Board will inspect the work to determine the projects compliance with the approved plans. The MHA Board shall notify the owner in writing of any non-compliance within ten (10) days and require the owner to remedy such non compliance within 30 days.

Proposed: Private Area Construction Policy
a. All exterior changes to a Member's structure, including but not limited to, painting, roofing, siding, fences, windows, or structural modifications must be approved by the MHA Board PRIOR TO the Member or Member's contractor(s) beginning work.
b. Routine maintenance, repairs, or replacements that restore or maintain the existing condition using identical materials, colors, and style do not require prior Board approval. This includes activities such as repainting with the same color, re-roofing with the same material and color, or replacing sections of a damaged fence with matching materials and design.
c. Repainting or Restaining:
- The applicant must submit a painted sample of each color (siding, trim and doors.) The MHA Board reserves the right to require the applicant to paint a portion of the home (not to exceed 50 square feet) as a sample prior to approving the color.
d. Re-roofing:
- Samples of the proposed material including the proposed roof color must be submitted with the application.
e. Fences:
- Fences are allowed only in back yards or side yards.
- Fences must be made of wood or other material approved by MHA Board and must be of natural color. Samples of the fence material must be submitted with the application.
- Drawings to scale including property boundaries and existing structures must be submitted with the application.
f. Remodels, Additions or Modifications to the Home:
- Any exterior remodel, addition or home modifications, including, but not exclusively limited to deck, swimming pool, tennis court, etc. requires MHA Board approval.
g. Landscaping and Tree Removal:
- Changes to the existing landscaping that includes repair or changes that do not excessively change the topography of the property do not require MHA Board approval.
All major tree removals and other landscape changes require MHA Board approval.
h. Procedure for approval:
- The owner must complete and submit a completed Design Approval Checklist to the MHA Board along with appropriate plans and specifications for the proposed work, including a plot plan; drawings with elevations; description of exterior materials and colors; samples; trees to be removed or altered; and a proposed construction schedule.

- Upon completion of work for which approved plans are required under this section, the Member shall give notice to the MHA Board. Within ten (10) days the MHA Board will inspect the work to determine the projects compliance with the approved plans. The MHA Board shall notify the owner in writing of any non-compliance within ten (10) days and require the owner to remedy such non compliance within 30 days.
i. Restoration of Common Areas:
- The Member is responsible for the repair and restoration of any MHA common area property including roads, shoulders, landscaping, fences, gates, and mailboxes that are disturbed or damaged by private construction, contractors, or delivery vehicles.
- All repairs must restore the damaged areas to their original condition at the Member’s expense and be completed within 30 days of project conclusion.
- If repairs are not completed within this timeframe, the MHA Board reserves the right to perform the restoration and assess all associated costs to the Member.

Proposed Changes Summary
- Policy structure updated to align with the format of other MHA policies.
- Sections (b) though (g) were previously part of the “Design Guidelines” document which made them hard to find or reference. They are now part of this policy and clarify which activities require approval from the MHA Board.
- Added new Section (i) to address the restoration of any common area property if damaged.
